DUPONT PAYS $38.5 MILLION TO SETTLE ACID BROOK SUIT

DuPont paid $38.5 million to settle a lawsuit brought by residents of Pompton Lakes, where DuPont operated an explosives factory for more than 90 years.  Plaintiffs alleged that DuPont improperly disposed of industrial metals and solvents by burning them in open pits or dumping them into a local stream called Acid Brook.  The factory closed in 1994

Plaintiffs alleged that high levels of lead, mercury, and other contaminants contributed to health problems ranging from brain cancer to attention deficit disorders.  This settlement provided money for injury compensation, continued medical care, lost property values, and diminution in the quality of the Plaintiffs' lives.  The lowest amount paid was $20,000, which went to each of the 25 children who showed no present signs of illness, but will require medical monitoring during their lives.
